General Terms and Conditions 



These General Terms and Conditions (hereinafter referred to as "GTCs") between Feinbäckerei Guggenloch AG as the seller and its customers (hereinafter referred to as CUSTOMER) apply to all orders placed in the Feinbäckerei Guggenloch AG online shop (www.guggenloch.ch) and to those purchases for which Feinbäckerei Guggenloch AG declares these General Terms and Conditions to be applicable. These GTCs do not apply to purchases made directly from Feinbäckerei Guggenloch AG. 


Scope and order

CUSTOMERs make their selection in the Feinbäckerei Guggenloch AG online shop and make Feinbäckerei Guggenloch AG an offer for the selected articles (hereinafter "offer" or "order") by completing the order. The illustrations, products, details and dimensional descriptions shown in the Guggenloch AG online shop are not binding and may differ from the actual articles. By placing an order, the CUSTOMER accepts these GTCs. Feinbäckerei Guggenloch AG will confirm receipt of an offer; however, this does not yet mean that the offer has been accepted. The article(s) are checked for availability. The article(s) are then sent by post. Feinbäckerei Guggenloch AG considers a CUSTOMER‘s offer to be accepted once the item(s) has/have been shipped. 


Prices and terms of payment

All prices are quoted in Swiss francs incl. VAT excl. shipping costs. The effective shipping costs are displayed in the shopping cart before the order is completed. Item and price changes as well as changes to the forwarding expenses remain expressly reserved. Payment is made by invoice or advance payment. 


Delivery

Orders are shipped by post, primarily within Switzerland. Delivery time from the time the order is placed is usually 3 to 5 working days. This information is without guarantee. The order can be made in several partial shipments. Feinbäckerei Guggenloch AG accepts no liability for any articles damaged during delivery. Benefit and risk are transferred to the CUSTOMER once the articles have been shipped.


Retention of title

The articles remain the property of Feinbäckerei Guggenloch AG until full payment has been received. Feinbäckerei Guggenloch AG reserves the right to have a retention of title entered in the retention of title register for the ordered articles. 


Right of return

Articles which are defective for reasons other than incorrect behaviour on the part of the CUSTOMER can also be returned within 10 days from the date of the delivery note at the CUSTOMER‘s own expense in the original packaging. Any defects must be recorded. Feinbäckerei Guggenloch AG will immediately review the defect. If Feinbäckerei Guggenloch AG accepts the defect, the CUSTOMER will receive a replacement of the same item, if in stock. Otherwise the payment will be credited back to the CUSTOMER. No cash payments are made. Articles not recognised as defective by Feinbäckerei Guggenloch AG are returned to the CUSTOMER, who is charged for postage costs and any expenses incurred. 


Data protection

Feinbäckerei Guggenloch AG undertakes to process customer data carefully and to comply with data protection regulations. Feinbäckerei Guggenloch AG uses personal data to process and fulfil the services offered in accordance with the contract and the law, to maintain customer relations and to develop, design and submit offers and articles in line with requirements. For marketing purposes, the data will be used for a maximum period of 24 months after its creation. An up-to-date list of the available categories of personal data can be found at www.guggenloch.ch or requested in writing from Feinbäckerei Guggenloch AG under the keyword "data protection".


Changes and various provisions

Feinbäckerei Guggenloch AG reserves the right to change the GTCs at any time and without prior notice.  The current version of the GTCs published at www.guggenloch.ch shall apply. The CUSTOMER shall be notified of any changes to the GTCs in an appropriate manner. 


Place of jurisdiction

Swiss law applies. Place of jurisdiction is St.Gallen. Mandatory legal provisions remain reserved.
